Online store.moderneenligne.com site was set up by Beauce Modern Printing inc., the operator of this site. Any order for a
product appearing on the online store website store.moderneenligne.com
requires prior consultation of these general conditions:
Accordingly, the consumer agrees to be fully informed of the fact
that its agreement on the content of these conditions does not require
the signature of this document, as the customer wishes to order online
the products presented in the framework of the shop website. The
consumer has the power to save or edit these Terms, provided that both
the backup as the edition of this document are the sole responsibility. The customer thus has specific rights, which would be
called into question on the assumption that the goods or services
acquired as part of the website would have actually connected with his
professional activity. Online shop set up by the Imprimerie Moderne de
Beauce Inc. lists the following information:
1. Legal notice allowing a precise identification of the company Beauce Modern Printing Inc.
2. Presentation of the essential characteristics of properties
3. Prices, in Canadian and US dollars for printed material and delivery charges
4. Indication of the arrangements for payment, delivery and delays
5. The existence of a right of withdrawal
6. All these informations are presented in English. The consumer
states have full legal capacity to commit him under these conditions
Article 1:
These conditions express the entirety of the
obligations of the parties. In this sense, the consumer is deemed to
accept without reservation the full provisions of these terms and
conditions. No general or specific condition set out in documents sent
or given by the consumer can be integrated into present, since these
documents are inconsistent with these terms and conditions.
Article 2: Purpose
These conditions aim to define the rights and obligations of the
parties in the online sale of goods and services offered by the company Beauce Modern Printing inc.
Article 3: Contractual documents
This contract is formed by the following contractual documents,
presented in descending hierarchical order: the present conditions, the
purchase order. In the event of conflict between the provisions
contained in the documents of different rank, the provisions of the
above document will prevail.
Article 4: Entry into force - length
These conditions come into force on the date of confirmation of order.
Article 5: Electronic signature
The double click of the consumer under the purchase order
constitutes an electronic signature which has, between the parties, the
same value as a handwritten signature.
Article 6: Order Confirmation
The contractual information will be confirmed by email no later
than the time of delivery or at the address indicated by the consumer
in the purchase order.
Article 7: Proof of the transaction
The records stored in computer systems of Beauce Modern Printing inc. under reasonable conditions of safety, will be
considered as proof of communications, orders and payments between the
parties.
Article 8: Product Information
8-a: The Company Beauce Modern Printing inc. shows on its
website all products with the informations necessary to let the potential consumer know before the final
order is processed, the essential characteristics of the products they wish to
buy.
Article 9: Price
Prices are in Canadian and US dollars and are valid until the date of
dispatch of order by the consumer. They do not include delivery
charges, billed as an extra, and indicated before the order. Applicable taxes are calculated to the days of the order depending on the
destination of delivery and any change in the tax rate will be
reflected in the prices on the online store. Payment of the full price
must be made when ordering. At no time, payments can not be regarded as
payments or installments.
Article 10: Payment
To set the order, the consumer can pay its order by PAYPAL using a credit card, or a PAYPAL account. The consumer provides the company Beauce Modern Printing inc. that it has the required permission to use
the method of payment chosen by him, during the validation of the
order. The company Beauce Modern Printing inc. reserves the right
to suspend any order management and delivery in case of refusal of
payment by credit card from officially accredited bodies or no payment.
The company Beauce Modern Printing inc. reserves the right to
refuse to make a delivery or an order from a consumer who has not
completely settled a previous order or with whom a payment dispute was
under administration.
Article 11: Production delays
The order will be produced within 6 days from the
date on which the consumer process its order. The consumer will receive a PDF proof within 24H (on weekdays) following its order. It will have then 24H to approve the PDF. The production delays will be respected by Beauce Modern Printing ONLY if: The PDF is approved within 24H on weekdays without any corrections that are not related with Beauce Modern Printing process. Each supplementary day of proofing will result with 1 day added to the order calculated delay.
Article 11a: Proofs and types of files
You must submit your files for printing in one of the following formats:
- Adobe PDF (high resolution);
- Adobe Illustrator;
- Adobe InDesign;
- Adobe Photoshop;
- Quark Xpress;
The only available proof format is the PDF secured. No paper proofing available.
NB: It is better to compress the files you wish to send before you upload them.
If files from a different format than those mentioned above are sent,
we could refuse the order or add costs not exceeding 10% of the total
(before taxes) of your order. We will call if necessary.
Article 12: Delivery
The products are delivered to the address specified by the
customer on the order form. Beauce Modern Printing inc. reserves
the right to refuse to produce an order which would be outside the
reasonable delivery. The consumer would be notified and fully
reimbursed. The consumer has to check the packaging of the goods upon
delivery and report any damage to the carrier on the delivery and the
company Beauce Modern Printing inc. In a period of two (2) days. The
consumer may, upon request, obtain sending an invoice to the billing
address and not the delivery address by validating the option provided
for this purpose on the order form. Regarding shipping, we work mainly
with UPS. When we do a shipment, you immediately receive an email
informing you.
Article 13: Delivery problems because of the carrier
Any anomaly concerning the delivery (damage, missing product
compared to the slip, damaged package ...) must imperatively be
indicated on the delivery form of "handwritten reserves", accompanied
by the signature of the customer. The consumer must confirm this
anomaly in parallel by sending the carrier within two (2) business days
following the date of delivery letter with acknowledgment of receipt
stating such claims. The consumer must send a copy of this letter by
fax or mail to:

Article 14: Delivery Errors
14-A: The consumer must make to society Beauce Modern Printing inc. the day of delivery or not later than the first business
day after delivery, any claim of error of delivery and / or
nonconformity of the printed material compared to the
entries on the order form. Any complaint made after this time will be
rejected.
14-b: The formulation of this claim with the company Beauce Modern Printing inc. be made - primarily by phone at 1-418-228-4011
Monday through Friday from 8 to 17h., - by logging on our website under
the heading "follow your command" "where, after entering your number
client, you can ask your question through the contact us menu
specifying the reference of the order.
14-c: Any claim not made in the rules defined above and in the
time limits could not be taken into account and will release the
company Beauce Modern Printing inc. of any responsibility.
To be accepted, any return must be reported to Customer prior to the company Beauce Modern Printing inc.
Mailing costs are borne by Beauce Modern Printing inc., except where it would prove that the product does not correspond
to the declaration of origin made by the consumer.
Article 16: Right of withdrawal
An order, when approved (in production - printing) can not
be cancelled. Cancellation prior to the approval of the test may be done
by communicating to this address: info@moderneenligne.com.
Management fee not exceeding 10% of the total order before taxes can be
applied in case of cancellation.
Article 18: Force majeure
Neither party will have failed in its contractual obligations,
insofar as its execution is delayed, hindered or prevented by a
fortuitous event or force majeure. Will be considered as fortuitous
event or force majeure or any unavoidable circumstances, external to
the parties, unpredictable, inevitable, independent of the will of the
parties and which could not be prevented by the latter, despite all
efforts reasonably possible. The party affected by such circumstances
shall notify the other within ten business days following the date on
which it will have been informed. The two sides closer, within one
month, unless unable due to force majeure, to examine the impact of the
event and agree on the conditions under which the contract will be
continued. If the force majeure has more than three months, these Terms
may be terminated by the injured party. With specifically, are
considered as force majeure or fortuitous events, in addition to those

the blocking of means of transport or, earthquakes, fires, storms,
floods, lightning; stop telecommunication networks or difficulties
specific to telecommunication networks to external customers.
Article 19: No partial validation
If one or more stipulations of these general conditions are held
to be invalid or declared as such pursuant to a statute, regulation or
following a final decision of a court of competent jurisdiction, all
other stipulations will retain their strength and their scope.
Article 20: No waiver
The fact that one party not to rely on a breach by the other party
to any of the obligations under these Terms shall be construed for the
future as a waiver of the requirement involved.
Article 21: Title
In case of difficulty of interpretation between any of the titles
appearing at the head of clauses, and any of the clauses, the titles
will be declared non-existent.
Article 22: Applicable Law
These general conditions are subject to Canadian law. This is for
the rules of funds as for the rules of form. In case of dispute or
claim, the consumer will apply in priority to the company Beauce Modern Printing inc. to obtain an amicable solution. In a second time
on appeal, the consumer may file a complaint with Beauce Modern Printing inc., by phone.
Article 23: Information and Freedom
The information requested to the consumer are needed to process
the order and may be provided to contractors of the company Beauce Modern Printing inc. involved in executing this command. Consumers
may write to the company Beauce Modern Printing inc. whose
coordinates are within the terms and conditions contained within the
website, to oppose such a communication, or to exercise its rights of
access, rectification in respect of information concerning and
contained in files of the company Beauce Modern Printing inc.
